                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to the name of the University of Houston-Clear Lake.
    1-3        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-4        SECTION 1.  The heading to Subchapter E, Chapter 111,
    1-5  Education Code, is amended to read as follows:
    1-6               SUBCHAPTER E.  THE UNIVERSITY OF HOUSTON
    1-7                       AT PASADENA<-CLEAR LAKE>
    1-8        SECTION 2.  Section 111.81, Education Code, is amended to
    1-9  read as follows:
   1-10        Sec. 111.81.  UNIVERSITY OF HOUSTON AT PASADENA<-CLEAR LAKE>.
   1-11  There is established in Harris County, as recommended by the Texas
   1-12  Higher Education Coordinating Board<, Texas College and University
   1-13  System>, a coeducational institution of higher education to be
   1-14  known as the University of Houston at Pasadena<-Clear Lake>.  The
   1-15  university shall be located on land currently owned by the
   1-16  University of Houston, either land acquired by donation under
   1-17  Chapter 37, Acts of the 60th Legislature, Regular Session, 1967, or
   1-18  land generally adjacent to that land and also owned by the
   1-19  University of Houston.
   1-20        SECTION 3.  Section 111.82, Education Code, is amended to
   1-21  read as follows:
   1-22        Sec. 111.82.  Organization and Control.  The organization and
   1-23  control of the university are vested in the board of regents of the
   1-24  University of Houston.  With respect to this university, the board
    2-1  of regents has all the rights, powers, and duties that it has with
    2-2  respect to the organization and control of the University of
    2-3  Houston, except as otherwise provided by this Act.  However, the
    2-4  University of Houston at Pasadena <Clear Lake City> shall be
    2-5  maintained as a separate and distinct institution of higher
    2-6  education.
    2-7        SECTION 4.  Section 111.84(c), Education Code, is amended to
    2-8  read as follows:
    2-9        (c)  The advisory committee shall periodically study the
   2-10  overall needs of the region mentioned in Subsection (a) of this
   2-11  section for the development of programs and resources in higher
   2-12  education, and as a result of its studies shall make
   2-13  recommendations to the board of regents of the University of
   2-14  Houston System regarding the development of the departments and
   2-15  degree programs of the University of Houston at Pasadena<-Clear
   2-16  Lake>.  The board of regents shall give careful consideration to
   2-17  the recommendations of the advisory committee.
   2-18        SECTION 5.  Section 111.91, Education Code, is amended to
   2-19  read as follows:
   2-20        Sec. 111.91.  Organization and Control.  The organization and
   2-21  control of the institution are vested in the board of regents of
   2-22  the University of Houston System.  With respect to this institution
   2-23  the board of regents has all the rights, powers, and duties that it
   2-24  has with respect to the organization and control of the University
   2-25  of Houston and the University of Houston at Pasadena <Clear Lake
   2-26  City> except as otherwise provided by this subchapter.  However,
   2-27  the University of Houston-Downtown College shall be maintained as a
    3-1  separate and distinct institution of higher education.
    3-2        SECTION 6.  Section 54.540, Education Code, is amended to
    3-3  read as follows:
    3-4        Sec. 54.540.  STUDENT CENTER FEE, UNIVERSITY OF HOUSTON AT
    3-5  PASADENA<-CLEAR LAKE>.  (a)  The Board of Regents of the University
    3-6  of Houston System may levy and collect a student center fee, not to
    3-7  exceed $40 per student for each regular semester and not to exceed
    3-8  $20 per student for each term of the summer session for the sole
    3-9  purpose of financing, constructing, operating, maintaining, and
   3-10  improving a student center for the University of Houston at
   3-11  Pasadena<-Clear Lake>.  The fees herein authorized to be levied are
   3-12  in addition to any use or service fee now or hereafter authorized
   3-13  to be levied.  The student center fee initially levied shall be in
   3-14  an amount approved by a majority vote of the students voting in an
   3-15  election called for that purpose.
   3-16        (b)  The student center fees shall be deposited to an account
   3-17  known as The University of Houston at Pasadena<-Clear Lake> Student
   3-18  Center Fee Account and shall be placed under the control of and
   3-19  subject to the order of the University Life Council.  The council
   3-20  shall annually submit to the board of regents a complete and
   3-21  itemized budget, a recommended fee level, and a complete report of
   3-22  all activities conducted during the past year and all expenditures
   3-23  made incident thereto.  The board of regents shall make such
   3-24  changes in the budget as it deems necessary before approving the
   3-25  budget.
   3-26        (c)  The board of regents may increase the student center fee
   3-27  levied under this section.  However, if the increase is more than
    4-1  10 percent above the previous fiscal year's fee, it must be
    4-2  approved by a majority of students voting in an election called for
    4-3  that purpose.
    4-4        SECTION 7.  Section 55.171(a), Education Code, is amended to
    4-5  read as follows:
    4-6        (a)  The board of regents of the University of Houston may
    4-7  acquire, purchase, construct, improve, enlarge, and equip property,
    4-8  buildings, structures, and facilities for the University of Houston
    4-9  at Pasadena <Clear Lake City>, and for these purposes may request
   4-10  the Texas Public Finance Authority to issue revenue bonds on behalf
   4-11  of the University of Houston pursuant to this subchapter.  The
   4-12  board may pledge irrevocably to the payment of these revenue bonds
   4-13  all or any part of the aggregate amount of student tuition charges
   4-14  required or authorized by law to be imposed on students enrolled at
   4-15  the University of Houston or the University of Houston at Pasadena
   4-16  <Clear Lake City>, or both; and the amount of any pledge so made
   4-17  shall never be reduced or abrogated while the bonds are
   4-18  outstanding.  However, the tuition charges shall not be pledged
   4-19  pursuant to the authority granted by this subsection except to the
   4-20  payment of bonds issued in an aggregate principal amount not to
   4-21  exceed $40 million for the purpose of providing funds to acquire,
   4-22  purchase, construct, improve, enlarge, and equip property,
   4-23  buildings, structures, and facilities for the University of Houston
   4-24  at Pasadena <Clear Lake City>.
   4-25        SECTION 8.  Section 62.021(a), Education Code, is amended to
   4-26  read as follows:
   4-27        (a)  Each fiscal year, an eligible institution is entitled to
    5-1  receive an amount allocated in accordance with this section from
    5-2  funds appropriated by Article VII, Section 17(a), of the
    5-3  Constitution of Texas.  The comptroller of public accounts shall
    5-4  distribute funds allocated under this subsection only on
    5-5  presentation of a claim and issuance of a warrant in accordance
    5-6  with Section 403.071, Government Code.  The comptroller may not
    5-7  issue a warrant from any funds allocated under this subsection
    5-8  before the delivery of goods or services described in Section 17,
    5-9  Article VII, Texas Constitution, except for the payment of
   5-10  principal or interest on bonds or notes.  The allocation of funds
   5-11  under this subsection is made in accordance with an equitable
   5-12  formula consisting of the following elements:  space deficit,
   5-13  facilities condition, institutional complexity, separate allocation
   5-14  for medical units, and additional allocation for compliance with
   5-15  the Texas Desegregation Plan.  The amounts allocated by such
   5-16  formula are as follows:

    7-7        SECTION 9.  Section 2(5)(A), Chapter 421, Acts of the 63rd

   12-6        SECTION 10.  (a)  The name of the University of Houston-Clear
   12-7  Lake is changed to the University of Houston at Pasadena.
   12-8        (b)  A reference in law to the University of Houston-Clear
   12-9  Lake means the University of Houston at Pasadena.
  12-10        (c)  An appropriation for the use and benefit of the
  12-11  University of Houston-Clear Lake is available for the use and
  12-12  benefit of the University of Houston at Pasadena.
  12-13        (d)  Before using new stationery or other supplies printed
  12-14  with the university's name as changed by this Act, the university
  12-15  shall use all stationery and other supplies that are printed with
  12-16  the university's former name and that are in its possession on the
  12-17  effective date of this Act.
  12-18        SECTION 11.  The importance of this legislation and the
  12-19  crowded condition of the calendars in both houses create an
  12-20  emergency and an imperative public necessity that the
  12-21  constitutional rule requiring bills to be read on three several
  12-22  days in each house be suspended, and this rule is hereby suspended,
  12-23  and that this Act take effect and be in force from and after its
  12-24  passage, and it is so enacted.
