Pursuant to suspension of Senate Rule 11.18, a public hearing of the Senate Committee on Business & Commerce was held on Tuesday, May 19, 2009, at Senator Fraser's Desk.

The chair called the meeting to order at 3:55 p.m.  There being a quorum present, the following business was transacted: 

 

The chair laid out as a matter of pending business HB 2649 and recognized Senator Averitt, in the absence of the Senate sponsor, to explain the bill.  Senator Jackson moved to withdraw the Committee substitute sent up at a previous hearing.  Without objection, it was so ordered.

 

At 3:57 p.m. Senator Fraser moved that the Committee stand at ease.  Without objection, it was so ordered.

 

At 3:59 p.m. the Committee came back to order.

 

Senator Averitt sent up a committee substitute; the chair recognized Senator Deuell to explain the difference between the committee substitute and the house bill as engrossed.  Senator Averitt sent up Committee Amendment 1 and explained the amendment.  Senator Averitt moved adoption of the committee substitute; without objection, it was so ordered.  Senator Averitt moved adoption of Committee Amendment 1; without objection, it was so ordered.  Senator Averitt then requested unanimous consent to roll the amendment and the committee substitute into a new committee substitute; without objection, it was so ordered.  Senator Averitt then moved that the committee substitute be adopted; without objection, it was so ordered.  Senator Averitt moved that HB 2649 do not pass but that CSHB 2649 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 8 ayes, 0 nay, 0 present not voting, and 1 absent.  Senator Averitt moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered. 

 

At 4:05 p.m. Senator Fraser moved that the committee stand recessed until the call of the chair; without objection, it was so ordered.
