Pursuant to a notice posted in accordance with Senate Rule 11.18, a public hearing of the Senate Committee on Veteran Affairs & Military Installations was held on Wednesday, May 20, 2009, in the Betty King Committee Room at Austin, Texas.

The chair called the meeting to order at 3:26 p.m.  There being a quorum present, the following business was transacted: 

 

The chair recognized Brigadier General Joyce L. Stevens from the Adjutant General's Department of Texas to lead the Pledge of Allegiance.

 

At 3:28 p.m. Senator Shapleigh assumed the chair. 

 

The chair laid out HB 2919 and recognized Senator Van de Putte, in the absence of the Senate sponsor, to explain the bill. 

 

No persons registering or testifying on HB 2919.  

 

The chair moved that the public testimony be closed; without objection, it was so ordered. 

 

Senator Van de Putte moved that HB 2919 be reported favorably to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 4 ayes, 0 nay, 0 present not voting, and 0 absent. 

 

At 3:30 p.m. Senator Van de Putte resumed the chair. 

 

The chair laid out HCR 5 and recognized Senator Shapleigh, in the absence of the Senate sponsor, to explain the bill. 

 

No persons registering or testifying on HCR 5.  

 

The chair moved that the public testimony be closed; without objection, it was so ordered. 

 

Senator Shapleigh moved that HCR 5 be reported favorably to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 4 ayes, 0 nay, 0 present not voting, and 1 absent. 

 

Senator Shapleigh moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered. 

 

The chair laid out HJR 7 and recognized Senator Shapleigh, in the absence of the Senate sponsor, to explain the bill. 

 

Witnesses testifying and registering on the bill are shown on the attached list. 

 

The chair moved that the public testimony be closed; without objection, it was so ordered. 

 

Senator Shapleigh moved that HJR 7 be reported favorably to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 3 ayes, 0 nay, 0 present not voting, and 2 absent. 

 

The chair laid out HB 3452 and recognized Senator Davis, in the absence of the Senate sponsor, to explain the bill.

Senator Davis sent up a committee substitute; the chair recognized Senator Davis to explain the difference between the committee substitute and the house bill as engrossed.

Senator Davis moved that HB 3452 do not pass but that CSHB 3452 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 4 ayes, 0 nay, 0 present not voting, and 1 absent. 

At 3:50 p.m. Senator Shapleigh assumed the chair. 

 

The chair laid out HB 269 and recognized the Senate sponsor, Senator Van de Putte, to explain the bill. 

 

Senator Van de Putte sent up a committee substitute; the chair recognized Senator Van de Putte to explain the difference between the committee substitute and the house bill as engrossed.
