A BILL TO BE ENTITLED
 
AN ACT
  relating to the regulation of fireworks in areas annexed by a
  municipality for limited purposes.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 43.002, Local Government Code, is
  amended by adding Subsection (e) to read as follows:
         (e)  A regulation relating to the sale and use of fireworks
  is subject to the restrictions in Section 43.133.
         SECTION 2.  Subchapter F, Chapter 43, Local Government Code,
  is amended by adding Section 43.133 to read as follows:
         Sec. 43.133.  SALE OR USE OF FIREWORKS IN ANNEXED AREA. A
  municipality that annexes an area for limited purposes under this
  subchapter may not prohibit the sale or use of fireworks in the
  area.
         SECTION 3.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution.  If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2011.
