A BILL TO BE ENTITLED
 
AN ACT
  relating to the use of certain state property for community food
  gardens.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  (a) The General Land Office shall develop a plan
  for the establishment of community food gardens on real property
  that:
               (1)  is owned or controlled by the state; and
               (2)  is not being used or is being substantially
  underused.
         (b)  The General Land Office shall work with other state
  agencies that own or control real property, including the Texas
  Department of Transportation, the Texas Department of Criminal
  Justice, and the Parks and Wildlife Department, in developing the
  plan.
         (c)  The plan must:
               (1)  identify real property owned or controlled by the
  state that is appropriate for the establishment of community food
  gardens;
               (2)  identify any statutory or other barriers to
  implementation of the plan and make recommendations for eliminating
  or addressing those barriers; and
               (3)  analyze the costs and benefits of implementation
  of the plan.
         (d)  Not later than September 1, 2012, the General Land
  Office shall submit the plan to the legislature.
         SECTION 2.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution. If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2011.
