A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to fines paid for the violation of a county regulation |
|
|
prohibiting or restricting outdoor burning. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 352.081, Local Government Code, is |
|
|
amended by adding Subsection (i) to read as follows: |
|
|
(i) Notwithstanding any other law, a fine collected under |
|
|
this section by a county shall be deposited to the credit of an |
|
|
account in the general fund of the county to be distributed only to |
|
|
volunteer fire departments located within the county. The |
|
|
commissioners court by order shall regulate the distribution to and |
|
|
use of the funds by a volunteer fire department. Funds distributed |
|
|
under this subsection must be used for a public purpose. In this |
|
|
subsection, "volunteer fire department" has the meaning assigned by |
|
|
Section 352.006. |
|
|
SECTION 2. This Act takes effect September 1, 2013. |
