AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

S.B. 374 requires state agencies to participate in the federal E-Verify program, which is an online system that compares information from a potential employee's Form I-9 to data from the United States Department of Homeland Security and Social Security Administration to ensure employment eligibility for all new employees. 

 

S.B. 347 requires that state agencies fulfill their commitment to our taxpayers, ensuring that public money only goes to people who are eligible to work in the United States.

 

S.B. 374 amends current law relating to requiring state agencies to participate in the federal electronic verification of employment authorization program, or E-verify.

 

RULEMAKING AUTHORITY

 

Rulemaking authority is expressly granted to the Texas Workforce Commission in SECTION 1 (Section  673.003, Government Code) of this bill.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Subtitle B, Title 6, Government Code, by adding Chapter 673, as follows:

 

CHAPTER 673.  VERIFICATION OF EMPLOYEE INFORMATION

 

Sec. 673.001.  DEFINITIONS.  Defines "E-verify program" and "state agency."

 

Sec. 673.002.  VERIFICATION.  Requires a state agency to register and participate in the E-verify program to verify information of all new employees.

 

Sec. 673.003.  RULES. Requires  the Texas Workforce Commission to adopt rules and prescribe forms to implement this chapter.

 

SECTION 2.  Effective date: September 1, 2015.
