A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to prohibiting the establishment of a health benefit |
|
|
exchange for purposes of certain federal law. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Title 8, Insurance Code, is amended by adding |
|
|
Subtitle L to read as follows: |
|
|
SUBTITLE L. FEDERAL PATIENT PROTECTION AND AFFORDABLE CARE ACT |
|
|
CHAPTER 1691. HEALTH BENEFIT EXCHANGE |
|
|
Sec. 1691.001. HEALTH BENEFIT EXCHANGE PROHIBITED. A |
|
|
health benefit exchange described in the Patient Protection and |
|
|
Affordable Care Act (Pub. L. No. 111-148), as amended by the Health |
|
|
Care and Education Reconciliation Act of 2010 (Pub. L. |
|
|
No. 111-152), may not be established in this state. |
|
|
SECTION 2. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2015. |
