Pursuant to a notice posted in accordance with Senate Rule 11.10 and 11.18, a public hearing of the Senate Committee on Agriculture, Water & Rural Affairs was held on Thursday, April 6, 2017, in the Capitol Extension, Room E1.012, at Austin, Texas.

The chair called the meeting to order at 12:33 PM. There being a quorum present, the following business was transacted:

 

The following members arrived after the roll was called:

At 12:35 PM Senator Creighton assumed the chair.

 

The chair laid out SB 1897 and recognized the author, Senator Perry, to explain the bill.

 

Senator Hinojosa sent up a committee substitute.  The chair recognized Senator Perry to explain the difference between the committee substitute and the senate bill as filed.  The chair moved adoption of the committee substitute; without objection, it was so ordered.

 

 

No witnesses testified and registered on the bill.

 

The chair moved that the public testimony be closed; without objection, it was so ordered.

 

Senator Creighton moved that CSSB 1897 be left pending.

 

At 12:36 PM Senator Perry resumed the chair.

 

The chair laid out SB 319 and recognized the author, Senator Watson, to explain the bill.

 

Senator Hinojosa sent up a committee substitute.  The chair recognized Senator Watson to explain the difference between the committee substitute and the senate bill as filed.

 

Senator Hinojosa sent up Committee Amendment 1 and moved adoption; without objection, the amendment was adopted.

 

Senator Hinojosa sent up Committee Amendment 2 and moved adoption; without objection, the amendment was adopted.

 

At 12:44 PM Senator Rodríguez assumed the chair.

 

Senator Perry sent up Committee Amendment 3 and moved adoption; without objection, the amendment was adopted.

 

At 12:47 PM Senator Perry resumed the chair.

 

Senator Rodríguez requested unanimous consent to incorporate committee amendments 1, 2, and 3 into a new committee substitute; without objection, it was so ordered.

 

Witnesses testifying and registering on the bill are shown on the attached list.

 

The chair moved that the public testimony be closed; without objection, it was so ordered.

 

The chair moved that CSSB 319 be left pending.

 

At 1:12 PM Senator Rodríguez assumed the chair.

 

As a matter of pending business the chair laid out CSSB 1897.

 

Senator Rodríguez moved that SB 1897 do not pass but that CSSB 1897 be reported back to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 5 ayes, 0 nays, 0 present not voting, and 2 absent.  Senator Creighton submitted a motion in writing requesting to be shown voting aye on CSSB 1897.

 

The chair moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered.

 

At 1:14 PM Senator Perry resumed the chair.

 

There being no further business, at 1:14 PM Senator Perry moved that the Committee stand recessed subject to the call of the chair. Without objection, it was so ordered.
