Pursuant to a notice posted in accordance with Senate Rule
11.18, a public hearing of the Senate Committee on Health and
Human Services was held on Monday, March 26, 2001, in the Senate
Chamber at Austin, Texas.

The chairman called the meeting to order at 10:05 a.m. The
following business was transacted.
The chairman laid out SB 1052 by Senator Shapleigh, relating to
rates and expenditures under the Medicaid and state child health
plan program in the Texas-Mexico border region.
The chairman laid out SB 1053 by Senator Shapleigh, relating to
rates and expenditures under the Medicaid and state child health
plan program in the Texas-Mexico border region.
The chairman laid out SB 1054 by Senator Shapleigh, relating to
rates and expenditures under the Medicaid and state child health
plan program in strategic investment areas.
The chairman laid out SB 1055 by Senator Shapleigh, relating to
rates and expenditures under the Medicaid and state child health
plan program in strategic investment areas.
The chairman laid out SB 1056 by Senator Shapleigh, relating to
capitation and reimbursement rates under the state child health
plan program in the Texas-Mexico border region.
The chairman recognized Senator Shapleigh to explain Senate
Bills 1052, 1053, 1054, 1055 and 1056.
At 10:08 a.m. a quorum was established.
Witnesses registering and testifying on Senate Bills 1052, 1053,
1054, 1055 and 1056 are shown on the attached list. There being
no other witnesses registered or responding to the chairman's
call for public testimony relating to Senate Bills 1052, 1053,
1054, 1055 and 1056, the chairman closed public testimony.
At the chairman's request, Senate Bills 1052, 1053, 1054, 1055
and 1056 were left pending.
The chairman laid out SB 1456 by Senator Lucio, relating to the
establishment of a Texas Pediatric Diabetes Research Working
Group in the Texas Department of Health, and recognized the
author to explain the bill.
Senator Madla sent up a committee substitute for SB 1456 and
Senator Lucio explained the differences between it and the bill
as filed.
Senator Madla moved the adoption of the committee substitute for
SB 1456. There being no objection, the motion prevailed by
unanimous consent.
Witnesses testifying and registering on the committee substitute
for SB 1456 are shown on the attached list. There being no
other witnesses registered or responding to the chairman's call
for public testimony relating to the committee substitute for SB
1456, the chairman closed public testimony.
Senators Gallegos and Nelson requested unanimous consent to be
shown voting "aye" on the committee substitute for SB 1456.
There being no objection, the motion prevailed by unanimous
consent.
Senator Madla moved that SB 1456 be reported to the Senate with
the recommendation that it do not pass, but that the committee
substitute adopted in lieu thereof do pass and be printed. The
motion prevailed by a vote of 7 ayes, 0 nays and 2 absent.
Senator Madla moved that the committee substitute for SB 1456 be
recommended for certification on the local and uncontested
calendar. There being no objection, the motion prevailed by
unanimous consent.
The chairman laid out SB 556 by Senator Duncan, relating to
prices of prescription drugs provided to Medicare recipients by
pharmacies participating in the Medicaid vendor drug program,
and recognized the author to explain the bill.
Senator Bernsen sent up a committee substitute for SB 556 and
Senator Duncan explained the differences between it and the bill
as filed.
Senator Bernsen moved the adoption of the committee substitute
for SB 556. There being no objection, the motion prevailed by
unanimous consent.
At 11:48 a.m. Senator Carona assumed presiding duties.
At 11: 52 a.m. Senator Moncrief resumed presiding duties.

regional injury prevention centers, and recognized the author to

Senator Carona moved the adoption of the committee substitute
for SB 1289. There being no objection, the motion prevailed by
unanimous consent.
Senator Shapleigh sent up committee amendment 1 and explained
it. Senator Shapleigh moved adoption of committee amendment 1.
There being no objection, the motion prevailed by unanimous
consent.
Senator Shapleigh moved that committee amendment 1 be rolled
into a new committee substitute for SB 1289 and that the new
committee substitute for SB 1289 be adopted. There being no
objection, the motion prevailed by unanimous consent.

penalties applicable for the violation of laws concerning the
processing and sale of meat and poultry products, and recognized

SB 766. There being no objection, the motion prevailed by
unanimous consent.

under and eligibility for temporary assistance for needy
families and for food stamps, and recognized the author.

The chairman laid out the March 22, 2001, minutes and called for
revisions. There being none, Senator Shapleigh moved their
approval. There being no objection, the motion prevailed by
unanimous consent.
By unanimous consent and upon a motion by Senator Bernsen, the
chairman recessed the committee at 12:46 p.m., until 30 minutes
after the adjournment of the Texas Senate. The chairman
announced that the committee would reconvene in room E1.028.
The chairman reconvened that Senate Committee on Health and
Human Services at 2:23 p.m. in room E1.028.
At 2:23 p.m. Senator Carona assumed presiding duties.

memorandum of understanding for services for persons needing
multiagency services, and recognized the author to explain the
bill.

pilot project to address the need for more child protective
services workers in certain regions of the state, and recognized

for SB 962. There being no objection, the motion prevailed by
unanimous consent.

The chairman laid out anew SB 556 by Senator Duncan, relating to
prices of prescription drugs provided to Medicare recipients by

which had been left pending to await the arrival of a quorum.
Senators Bernsen and Shapleigh asked unanimous consent to be
shown voting "aye" on the committee substitute for SB 556.
There being no objection, the motion prevailed by unanimous
consent.
Senator Gallegos moved that SB 556 be reported to the Senate
with the recommendation that it do not pass, but that the
committee substitute adopted in lieu thereof do pass and be
printed. The motion prevailed by a vote of 5 ayes, 0 nays and 4
absent.
There being no other business to come before the committee and
upon a motion by Senator Carona, the chairman recessed the
committee by unanimous consent at 2:52 p.m., subject to the call
of the chairman.
