Pursuant to a notice posted in accordance with Senate Rule
11.18, a public hearing of the Senate Committee on Health and
Human Services was held on Thursday, April 19, 2001, in the
Senate Chamber at Austin, Texas.

The chairman called the meeting to order at 8:16 a.m. The
following business was transacted.
The chairman laid out SB 1536 by Senator Madla, relating to the
creation of pilot projects for demonstrating the application of
technology to the provision of long-term care, community care,
and certain other medical assistance, and recognized the author
to explain the bill.
Senator Madla sent up a committee substitute for SB 1536 and
explained the differences between
it and the bill as filed.
Witnesses testifying and registering on the committee substitute
for SB 1536 are shown on the attached list. There being no
other witnesses registered or responding to the chairman's call
for
public testimony relating to the committee substitute for SB
1536, the chairman closed public testimony.
The chairman left the committee substitute for SB 1536 pending
temporarily, to await the arrival of a quorum.
At 8:18 a.m. Senator Madla assumed presiding duties.
The chairman laid out SB 962 by Senator Moncrief, relating to a
pilot program to address the need for more child protective
service workers in certain regions of the state, and recognized
the author to explain the bill.
Senator Moncrief sent up a committee substitute for SB 962 and
explained the differences between it and the bill as filed.
No witnesses testified or registered on the committee
substitute for SB 962.
The chairman left the committee substitute for SB 962 pending
temporarily, to await the arrival of a quorum.
At 8:21 a.m. Senator Moncrief resumed presiding duties.
The chairman laid out anew SB 1053 by Senator Shapleigh,
relating to rates and expenditures under the medicaid and state
child health plan program in the Texas-Mexico border region,
which had been left pending from a previous hearing, and
recognized the author.
Senator Shapleigh sent up a committee substitute for SB 1053 and
explained the differences between it and the bill as filed.
There being no other witnesses registered or responding to the
chairman's call for public testimony relating to the committee
substitute for SB 1053, the chairman closed public testimony.
The chairman left the committee substitute for SB 1053 pending
temporarily, to await the arrival of a quorum.
The chairman laid out SB 283 by Senator Nelson, relating to
special disease management programs for certain recipients of
medical assistance under the Medicaid managed care program, and
recognized the author to explain the bill.

to SB 284, the chairman closed public testimony.

The chairman laid out SB 535 by Senator Carona, relating to the
continuation of the Texas Department on Aging, and recognized
Senator Madla, in absence of the author, to explain the bill.
Senator Madla sent up a committee substitute for SB 535 and
explained the differences between it and the bill as filed.
Testimony on the committee substitute for SB 535 began.
At 9:23 a.m. Senator Nelson assumed presiding duties.
At 9:46 a.m. Senator Moncrief resumed presiding duties.
The chairman laid out anew SB 283 by Senator Nelson, relating to
special disease management programs for certain recipients of
medical assistance under the Medicaid managed care program,
which had been left pending to await the arrival of a quorum.
Senators Gallegos, Nelson and Shapleigh asked unanimous consent
to be shown voting "aye" on SB 283. There being no objection,
the motion prevailed by unanimous consent.
Senator Madla moved that SB 283 be reported to the Senate with
the recommendation that it do pass and be printed. The motion
prevailed by a vote of 7 ayes, 0 nays and 2 absent.
Senator Madla moved that SB 283 be recommended for certification
on the local and uncontested calendar. There being no objection,
the motion prevailed by unanimous consent.
At 9:47 a.m. a quorum was established.
The chairman laid out anew SB 284 by Senator Nelson, relating to
streamlining reporting requirements and inspection procedures
under the Medicaid managed care program, which had been left
pending to await the arrival of a quorum.
Senator Carona sent up committee amendment 1 and explained it.
Senator Carona moved the adoption of committee amendment 1.
There being no objection, the motion prevailed by unanimous
consent.
Senator Carona moved that committee amendment 1 be rolled into a
committee substitute for SB 284 and the committee substitute for
SB 284 be adopted. There being no objection, the motion
prevailed by unanimous consent.
Senators Gallegos and Nelson asked unanimous consent to be shown
voting "aye" on the committee substitute for SB 284. There
being no objection, the motion prevailed by unanimous consent.
Senator Carona moved that SB 284 be reported to the Senate with
the recommendation that it do not pass, but that the committee
substitute adopted in lieu thereof do pass and be printed. The
motion prevailed by a vote of 7 ayes, 0 nays and 2 absent.

recommended for certification on the local and uncontested

At 9:52 a.m. Senator Moncrief resumed presiding duties.
The chairman laid out anew SB 1246 by Senator Gallegos, relating
to the establishment of a community health center revolving loan
fund program, which had been left pending from a previous
hearing.
Senator Shapleigh moved to roll the adopted amendment into a
committee substitute for SB 1246 and that the committee
substitute for SB 1246 be adopted. There being no objection,
the motion prevailed by unanimous consent.
Senators Gallegos and Nelson asked unanimous consent to be shown
voting "aye" on the committee substitute for SB 1246. There
being no objection, the motion prevailed by unanimous consent.
Senator Shapleigh moved that SB 1246 be reported to the Senate
with the recommendation that it do not pass, but that the
committee substitute adopted in lieu thereof do pass and be
printed. The motion prevailed by a vote of 7 ayes, 0 nays and 2
absent.
Upon unanimous consent, the chairman recessed the committee at
9:53 a.m., until 30 minutes after the adjournment of the Texas
Senate.
The chairman reconvened the Senate Committee on Health and Human
Services at 3:31 p.m.

The chairman laid out the April 5 and 9, 2001, minutes and
called for revisions. There being none, Senator Carona moved
their adoption. There being no objection, the motion prevailed
by unanimous consent.
No action was taken on the following bills:
HB 102 by Maxey, relating to abolishing the electronic imaging
program of the Texas Department of Human Services; and,
SB 527 by Senator Moncrief, relating to imposition of
administrative penalties against assisted living facilities.
There being no other business to come before the committee and
upon a motion by Senator Gallegos, the chairman recessed the
committee by unanimous consent at 3:59 p.m., subject to the call
of the chairman.
