         Pursuant to a notice posted in accordance with Senate Rule  
         11.18, a public hearing of the Joint Committee on Nutrition &  
         Health in Public Schools was held on Tuesday, June 29, 2004, in  
         the Capitol Extension, Room E1.012, at Austin, Texas.

         Chairman Lucio called the meeting to order at 10:07 a.m.  There  
         being a quorum present, the following business was transacted:   
          
         Chairman Lucio welcomed members of the Committee and gave  
         opening remarks.  
          
         Vice-Chair Laubenberg moved adoption of the minutes from the  
         previous hearing held on June 29, 2004; Commissioner Combs  
         seconded the motion, and without objection, it was so ordered.   
          
         The Chair requested the commissioners to provide updates  
         regarding their research on the charges which were divided among  
         the members during the previous hearing.  
          
         Commissioner Combs, Commissioner Neeley and Barbara Keir with  
         the Texas Department of Health presented their findings to the  
         Committee.  
         Members of the Committee offered comments on the updates.  
          
         The Chair then heard invited testimony on the charges.   
         Witnesses testifying as part of invited 
         testimony are shown on the attached list.  
          
         At 12:45 p.m. Vice-Chair Laubenberg assumed the chair.   
          
         At 1:20 p.m. Senator Lucio, Jr. resumed the chair.   
          
         At 1:45 p.m. the Chair opened public testimony regarding the  
         interim charges.  Witnesses testifying 
         and registering their positions on the charges are shown on the  
         attached list.   
          
         At 4:45 p.m., public testimony was closed.   
          
         At 4:48 p.m. Vice-Chair Laubenberg moved that the committee  
         stand recessed subject to the call of 
         the Chair.  Without objection, it was so ordered.
