LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 82ND LEGISLATIVE REGULAR SESSION

April 28, 2011

TO:
Honorable Tommy Williams, Chair, Senate Committee on Transportation & Homeland Security

FROM:
John S O'Brien, Director, Legislative Budget Board

IN RE:
HB588 by Guillen (Relating to surcharges under the Driver Responsibility Program.), As Engrossed

No significant fiscal implication to the State is anticipated.

The bill would amend Chapter 708 of the Transportation Code to require, rather than authorize, the Department of Public Safety (DPS) to offer an incentive program to a person who is assessed an annual surcharge under the Driver Responsibility Program (DRP) for compliance that includes a reduction of a surcharge or decrease in the length of an installment plan. The bill would require DPS to offer an option for a single up-front payment to pay the total amount that will be owed under DRP.

The incentive program that would be required by the bill is not expected to have a significant fiscal impact. The single up-front payment method would not impact the amount of revenue received under DRP, only the year in which revenue is received. The number of people that would use the single payment option cannot be determined, but it is not anticipated to be a large enough number to have a significant impact on the timing of revenue collections. Based on the analysis provided by DPS, it is assumed any cost to implement the bill could be absorbed within existing resources.

Local Government Impact

No fiscal implication to units of local government is anticipated.
