Pursuant to a notice posted in accordance with Senate Rule 11.10 and 11.18, a public hearing of the Senate Committee on Education was held on Thursday, April 7, 2011, in the Capitol Extension, Room E1.028, at Austin, Texas.

Senator Van de Putte called the meeting to order at 9:02 AM. The following business was transacted:

 

The chair laid out SB 1410 and recognized the author, Senator Duncan, to explain the bill.  Senator Van de Putte sent up a committee substitute; the chair recognized Senator Duncan to explain the difference between the committee substitute and the senate bill as filed. Witnesses testifying and registering on the bill are shown on the attached list. The chair moved that the public testimony be closed; without objection, it was so ordered.

 

Senator Van de Putte moved that SB 1410 be left pending; without objection, it was so ordered.

 

The chair laid out SB 1620 and recognized the author, Senator Duncan, to explain the bill. Senator Patrick sent up a committee substitute; the chair recognized Senator Duncan to explain the difference between the committee substitute and the senate bill as filed.  Witnesses testifying and registering on the bill are shown on the attached list. The chair moved that the public testimony be closed; without objection, it was so ordered. 

 

Senator Van de Putte moved that SB 1620 be left pending; without objection, it was so ordered.

 

At 9:25 AM Senator Carona assumed the chair.

 

The chair laid out SB 1622 and recognized the author, Senator Van de Putte, to explain the bill.  Witnesses testifying and registering on the bill are shown on the attached list. The chair moved that the public testimony be closed; without objection, it was so ordered. 

 

The bill was left pending.

 

At 9:38 AM Senator Van de Putte resumed the chair.

 

The chair laid out SB 1557 and recognized the author, Senator Carona, to explain the bill.  Senator Carona sent up a committee substitute; the chair recognized Senator Carona to explain the difference between the committee substitute and the senate bill as filed.  Witnesses testifying and registering on the bill are shown on the attached list. The chair moved that the public testimony be closed; without objection, it was so ordered.

 

Senator Van de Putte moved that SB 1557 be left pending; without objection, it was so ordered.

 

At 9:59 AM, Senator Van de Putte moved that the committee stand recessed until after the

adjournment of the Senate; without objection, it was so ordered.

 

Senator Shapiro reconvened the meeting at 1:48 PM and a quorum was present.

 

The chair laid out SB 718 and recognized the author, Senator Van de Putte, to explain the bill.  Senator Van de Putte sent up a committee substitute; the chair recognized Senator Van de Putte to explain the difference between the committee substitute and the senate bill as filed. Senator Van de Putte moved adoption of the committee substitute; without objection, it was so ordered.  Witnesses testifying and registering on the bill are shown on the attached list. The chair moved that the public testimony be closed; without objection, it was so ordered.

The chair laid out SB 208 and recognized the author, Senator Gallegos, to explain the bill.  Senator Gallegos, Jr. sent up a committee substitute; the chair recognized Senator Gallegos, Jr. to explain the difference between the committee substitute and the senate bill as filed. Witnesses testifying and registering on the bill are shown on the attached list. The chair moved that the public testimony be closed; without objection, it was so ordered.

 

Senator Shapiro moved that SB 208 be left pending; without objection, it was so ordered.

 

At 2:13 PM Senator Shapiro moved that the committee stand at ease; without objection, it

was so ordered.

 

At 2:14 PM Senator Shapiro called the committee to order.

 

The roll was called, and a quorum was present.

 

As a matter of pending business, the chair laid out SB 208.  Senator Patrick moved adoption of the committee substitute previously sent up; without objection, it was so ordered.  Senator Patrick moved that SB 208 do not pass but that CSSB 208 be reported back to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 8 ayes, 0 nays, 0 present not voting, and 1 absent.  Senator Patrick moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered.

 

As a matter of pending business, the chair laid out SB 1410.  Senator Seliger moved adoption of the committee substitute previously sent up; without objection, it was so ordered.  Senator Seliger moved that SB 1410 do not pass but that CSSB 1410 be reported back to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 8 ayes, 0 nays, 0 present not voting, and 1 absent. Senator Seliger moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered. 

 

As a matter of pending business, the chair laid out SB 1620.  Senator Patrick sent up Committee Amendment 1  to the proposed substitute previously sent up and moved adoption; without objection, the amendment was adopted.  Senator Patrick requested unanimous consent to incorporate the amendment into the committee substitute; without objection, it was so ordered. Senator Patrick then moved that the committee substitute be adopted; without objection, it was so ordered. Senator Davis moved that SB 1620 do not pass but that CSSB 1620 be reported back to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 8 ayes, 0 nays, 0 present not voting, and 1 absent.  Senator Davis moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered. 

 

As a matter of pending business, the chair laid out SB 718.  Senator Davis moved that SB 718 do not pass but that CSSB 718 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 8 ayes, 0 nays, 0 present not voting, and 1 absent.  Senator Patrick moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered. 

 

Senator Carona requested unanimous consent to be shown voting aye on SB 208, SB 718, SB 1410, and SB 1620; there being no objection, it was so ordered.

 

Senator West requested unanimous consent to be shown voting aye on SB 208, SB 1410,

and SB 1620; there being no objection, it was so ordered.
