Pursuant to a notice posted in accordance with Senate Rule 11.10 and 11.18, a public hearing of the Senate Committee on Education was held on Tuesday, March 5, 2013, in the Capitol Extension, Room E1.028, at Austin, Texas.

The chair called the meeting to order at 8:31 AM. The following business was transacted:

 

Senator Dan Patrick announced that public testimony on posted bills would be taken up during the afternoon portion of the committee hearing.

 

The chair laid out SB 115 and recognized the author, Senator Williams, to explain the bill.  Senator Royce West sent up a committee substitute; the chair recognized Senator Tommy Williams to explain the difference between the committee substitute and the senate bill as filed.  Invited witnesses testifying and registering on the bill are shown on the attached list.  The chair moved that the invited testimony be closed; without objection, it was so ordered. 

 

Senator Dan Patrick moved that SB 115 be left pending; without objection, it was so ordered.  

The chair laid out SB 132 and recognized the author, Senator Nelson, to explain the bill.  Invited witnesses testifying and registering on the bill are shown on the attached list.  The chair moved that the invited testimony be closed; without objection, it was so ordered.  

 

Senator Dan Patrick moved that SB 132 be left pending; without objection, it was so ordered.

 

The chair laid out SB 185 and recognized the author, Senator Deuell, to explain the bill.  Senator Dan Patrick moved that SB 185 be left pending temporarily; without objection, it was so ordered.   

 

The chair laid out SB 684 and recognized the author, Senator Deuell, to explain the bill.  Invited witnesses testifying and registering on the bill are shown on the attached list.  The chair moved that the invited testimony be closed; without objection, it was so ordered.

 

Senator Dan Patrick moved that SB 684 be left pending; without objection, it was so ordered.

 

As a matter of pending business, the chair called the following invited witnesses to provide testimony on SB 185.  See attached list.  The chair moved that the invited testimony be closed; without objection, it was so ordered.  The chair called persons who registered as public witnesses to provide testimony on SB 185.  See attached list.  The chair moved that the public testimony be closed; without objection, it was so ordered.

 

At 9:36 AM the roll was called, and a quorum was present.

 

Senator Eddie Lucio, Jr. moved adoption of the minutes from the previous hearings held on February 12, 2013, February 19, 2013, February 21, 2013, and February 27, 2013; without objection, it was so ordered.

 

Senator Royce West moved that SB 185 be reported favorably to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 8 ayes, 0 nays, 0 present not voting, and 1 absent.  Senator Royce West moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered.       

 

The chair laid out SB 317 and recognized the author, Senator Uresti, to explain the bill.  Senator Dan Patrick moved that SB 317 be left pending; without objection, it was so ordered.

 

At 9:46 AM Senator Royce West assumed the chair.

 

The chair laid out SB 573 and recognized the author, Senator Patrick, to explain the bill.  Invited and public witnesses testifying and registering on the bill are shown on the attached list. 

 

At 10:00 AM Senator Eddie Lucio, Jr. assumed the chair.

 

The chair moved that the testimony be closed; without objection, it was so ordered.  Senator Eddie Lucio, Jr. moved that SB 573 be left pending; without objection, it was so ordered.

 

At 10:30 AM Senator Dan Patrick resumed the chair. 

 

The chair laid out SB 715 and recognized the author, Senator Lucio, to explain the bill.  Invited witnesses testifying and registering on the bill are shown on the attached list.  The chair moved that the invited testimony be closed; without objection, it was so ordered.

The chair laid out SB 401 and recognized the author, Senator Lucio, to explain the bill.  Senator Larry Taylor sent up a committee substitute; the chair recognized Senator Eddie Lucio, Jr. to explain the difference between the committee substitute and the senate bill as filed.  Invited witnesses testifying and registering on the bill are shown on the attached list.  The chair moved that the invited testimony be closed; without objection, it was so ordered.

The chair laid out SB 521 and recognized the author, Senator Paxton, to explain the bill.  Senator Larry Taylor sent up a committee substitute; the chair recognized Senator Ken Paxton to explain the difference between the committee substitute and the senate bill as filed.  Invited witnesses testifying and registering on the bill are shown on the attached list.  The chair moved that the invited testimony be closed; without objection, it was so ordered.

 

Senator Dan Patrick moved that SB 521 be left pending; without objection, it was so ordered.

 

The chair laid out SB 713 and recognized the author, Senator Lucio, to explain the bill.  Senator Donna Campbell sent up a committee substitute; the chair recognized Senator Eddie Lucio, Jr. to explain the difference between the committee substitute and the senate bill as filed.  Invited witnesses testifying and registering on the bill are shown on the attached list.  The chair moved that the invited testimony be closed; without objection, it was so ordered.

 

Senator Dan Patrick moved that SB 713 be left pending; without objection, it was so ordered. 

 

There being no further business, at 10:58 AM Senator Patrick moved that the Committee stand recessed until 15 minutes after adjournment of the Senate. Without objection, it was so ordered.

 

Senator Patrick reconvened the meeting at 1:30 PM.
