Pursuant to a notice posted on March 24, 2025, the House Committee on Appropriations met in a formal meeting and was called to order by the chair, Representative Bonnen, at 4:01 p.m.

 

The initial quorum call was answered as follows: Representatives Bonnen; González, Mary; Barry; Collier; DeAyala; Fairly; Garcia Hernandez, Cassandra; Gervin-Hawkins; Goodwin; Harrison; Howard; Kitzman; Lopez, Janie; Lozano; Lujan; Oliverson; Orr; Slawson; Tepper; Villalobos; and Walle.

The chair laid out the Subcommittee Report on Articles I, IV, and V.

 

Representative Harrison raised a point of order against further consideration of the Subcommittee Report under Rule 4, Section 19A(a), of the House Rules.

 

The chair overruled the point of order, announcing his decision as follows:

Under the precedents printed in the House Rules Manual on page 60, points of order related to alleged parliamentary errors in committee are not in order when valid committee reports are before the House. Under Rule 4, Section 45, the same principle applies to points of order made in committee concerning subcommittee procedure.

 

Rule 4, Section 19A, poses an affirmative duty only on the Committee on House Administration. This committee has a valid subcommittee report before it that was adopted by a majority vote with a quorum present. The point of order is respectfully overruled.

 

Representative Harrison appealed the ruling of the chair. The appeal was seconded by Representative Lozano. There being an insufficient number of seconds, the appeal was not taken.

 

The chair recognized Representative Gonzalez, Mary to explain the Subcommittee Report on Articles I, IV, and V.

 

Representative DeAyala moved the adoption of the Subcommittee Report on Articles I, IV, and V. The motion prevailed by the following record vote:

With the consent of the Committee, the chair directed the Legislative Budget Board staff to do the following in order to produce the committee substitute for Senate Bill 1:

 

Ensure that FTE adjustments are made to conform to committee decisions.

 

Adjust the informational item on agencies that generate their own revenues to ensure that the agencies generate enough money to cover not only the amounts identified within the bill pattern but also indirect costs such as employee benefits, social security, etc. if appropriated elsewhere in the bill. This information will be based on the decisions adopted by the full committee for employee benefits.

 

Adjust informational items following each agency's bill pattern that identifies "Object of Expense Informational Listing" to conform to the committee's decisions.

 

Make technical adjustments to riders and performance measure targets to conform to committee's decisions.

 

Align appropriations among strategies and methods of finance, between years and to the appropriate bill patterns to conform to committee decisions.

 

Adjust the informational listing in agency bill patterns for the percentage of funds available to the agency represented in the agency’s bill pattern to conform to committee decisions.

 

Adjust the provisions and informational listings in Article IX, including the informational listing of Appropriations for Mental Health Services, to conform to committee decisions.

 

Adjust capital budget authority to conform to committee decisions.

 

Adjust the employee benefits (retirement, group insurance, social security, benefit replacement) appropriations to reflect final FTE counts based upon the policies established by the House Appropriations Committee.

 

Allocate appropriations from General Provisions and General Government agencies to the appropriate agency or functional grouping of agencies by Method of Financing for items that are made elsewhere, such as Retirement and Group Insurance, Social Security and Benefit Replacement Pay, Bond Debt Service Payments, and Lease Payments.

 

At the discretion of the House Appropriations Committee Chairman, make necessary technical adjustments.

 

At 4:29 p.m., on the motion of the chair and without objection, the meeting was adjourned subject to the call of the chair.
